Service Agreement Template

Deliverables: 15–20 carefully selected and edited photographs in the Service Provider’s artistic style — colour editing and tonal work based on the Service Provider’s presets (colour or black-and-white) — delivered digitally within 14 days of the session, provided that the full payment has been received within the agreed timeframe.

Retouching is limited to minor temporary skin blemishes where relevant. No body modification, skin smoothing, or perfection retouching is applied.

The session also includes one photo print (un-framed) selected by the Service Provider, delivered at a time to be agreed. Raw files are not included and will not be shared.

TERMS

1. Total Fee

The total fee for the portrait session is €350 (three hundred and fifty euros).

2. Payment

A booking fee of €75 (seventy-five euros) is due within 3 working days of the Client’s written confirmation of this agreement. This fee covers concept development, planning, and reservation of the session date. The remaining balance of €275 (two hundred and seventy-five euros) is payable within 1 (one) working day after the session. Payment is made by bank transfer to the Service Provider’s account stated above. No invoice is issued; this agreement and the Client’s written confirmation serve as the payment basis. Payment of the booking fee constitutes acceptance of the terms and conditions of this agreement. By making the booking fee payment, the Client confirms having read and understood the cancellation and refund terms set out in this agreement.

3. Cancellation

If the session is cancelled by the Service Provider, the booking fee of €75 will be returned to the Client in full within 5 working days via bank transfer to the bank account from which it was originally received. If the session is cancelled by the Client for any reason, the booking fee is non-refundable.

4. Rescheduling

The Client may reschedule the session up to 2 (two) times at no additional charge, provided that notice is given no later than 24 hours before the scheduled session time. Further rescheduling requests may be subject to an additional fee. The session may also be rescheduled at no charge by mutual agreement in the event of adverse weather conditions. Rescheduling initiated by the Service Provider does not count towards the Client’s two permitted reschedules.

5. Technical Failures

In the unlikely event of a technical failure on the part of the Service Provider (including but not limited to equipment malfunction, memory card failure, or data loss) that results in the loss of session images, the Service Provider’s liability is limited to offering a complimentary reshoot session of equivalent scope. No monetary refund will be issued in such circumstances. The Service Provider will make reasonable efforts to notify the Client promptly and to schedule the reshoot at a mutually convenient time.

6. Image Rights: The Service Provider retains the right to use session images for portfolio, exhibition, and promotional purposes unless otherwise agreed in writing. The Client receives a personal and commercial use licence for the delivered images. Any publication of the images beyond personal social media use requires prior written agreement with the Service Provider and attribution of authorship in the format: “Photo: Anna Chekryshova”.

7. Image Delivery Edited photographs are delivered via an online gallery within 14 days of the session date, provided that the full payment has been received. The gallery remains accessible for 3 months from the date of delivery. The Client is responsible for downloading all images within this period. Re-upload of images after gallery expiry is available for an additional fee. The Service Provider is under no obligation to retain or re-deliver images after 12 months from the session date. If the remaining balance is not received within 7 days of the session date, the Service Provider reserves the right to cancel the delivery of all edited images. In this case, the booking fee remains non-refundable. Raw, unedited image files are not included in the deliverables and are not shared under any circumstances.

8. Artistic Style & Refunds The Service Provider’s artistic style — including editing approach, composition, and overall aesthetic — is publicly visible in the Service Provider’s portfolio prior to booking. By confirming this agreement, the Client acknowledges familiarity with the Service Provider’s work and style. No refund will be issued on the basis of dissatisfaction with the artistic result. The Service Provider does not make editorial adjustments upon client request — including but not limited to reducing the appearance of wrinkles, blemishes, or other natural features. The editing scope is defined in the Deliverables section of this agreement. Exposure, tone, and local adjustments are made at the Service Provider’s discretion as part of the artistic edit and are not adjusted upon request.

9. Acceptance This agreement is considered accepted upon the Client’s written confirmation by email. No physical signature is required. The date of the confirming email constitutes the agreement date.

In lieu of signature: a written confirmation of agreement with the terms and conditions of this document, including the Client’s full legal name, sent to annachekryshova@gmail.com, constitutes acceptance of this agreement.

Payment of the booking fee independently constitutes acceptance of all terms and conditions set out in this agreement.

10. Governing Law This agreement is governed by the laws of the Republic of Estonia.

11. Professional Conduct The Service Provider reserves the right to terminate the session immediately and without refund if the Client behaves in a manner that is disrespectful, threatening, or otherwise inappropriate. In such cases, the booking fee and any payments made remain non-refundable. The Service Provider’s decision in this regard is final.The session duration is approximately 1.5–2 hours. The Service Provider reserves the right to conclude the session within this timeframe once sufficient material has been captured, regardless of requests to extend. The total fee remains unchanged regardless of the actual duration of the session, provided it falls within the agreed timeframe.
